A Delhi court on Friday handed a six-month prison sentence to former Madhya Pradesh legislator Kishore Samrite for issuing a threat to detonate a bomb at Parliament in September 2022 over his unmet demands. “The accused has been awarded six months of imprisonment for the offence under Section 506 Part II of the Indian Penal Code, along with a monetary penalty,” said Special Judge Vikas Dhull.
A package containing a suspicious material allegedly linked to explosives, along with the Indian national flag and a copy of the Constitution, was delivered via speed post to the Parliament House on September 16, 2022.
According to the judge, a letter from Samrite — formerly an MLA from Lanji in Balaghat — included a threat to destroy the Parliament building, which amounted to an intent to cause property damage by fire,
thereby making him culpable under Section 506(II) of the IPC.However, the judge cleared Samrite of the charges under the Explosives Act, stating that the item involved did not qualify as an “explosive” under the legal definition in the statute.
Samrite was defended by advocate Manish Kumar Choudhary. The court had earlier granted him bail in December 2022, observing that the alleged bomb threat did not lead to any actual detonation or harm to life or property.
The package also contained a ten-page signed grievance from Samrite, which revealed his discontent with government policies and included a list of 70 specific demands, accompanied by a warning that the Parliament would be attacked on September 30, 2022, if the demands were not addressed.
Further probe uncovered that Samrite had dispatched a similar envelope to the Supreme Court on September 19, 2022, prompting the registration of a separate FIR.
